Alabama Man Sentenced to Death for Murder of Pregnant Wife
A Marshall County judge has sentenced a north Alabama man to death for the second time in the 2009 death of the pregnant wife.
Al.com reports (http://bit.ly/20sXG0V ) that Circuit Judge Tim Riley resentenced 36-year-old Jessie Phillips on Friday. Phillips was convicted in 2012 of killing his wife, Erica Droze, and her unborn child at a car wash in 2009.
In December, the Alabama Court of Criminal Appeal remanded the Phillips case back to the trial court because the court, during his first sentencing, had not made written note of mitigating circumstances in Phillips’ background.
Phillips was the first person tried under the “Brody Law,” which allowed unborn children to be counted as a second victim in homicide cases. It was named after a 2005 shooting that killed Brandy Parker and her unborn son Brody in Albertville.
